In that event, your damages, if any, shall be limited solely to the return of the bid amount tendered at sale, plus interest. Default having been made in the terms and conditions of a certain Mortgage made between WAYNE ROBERT GAVENDA, a single man, whose address is 301 S. St. Johns Street, Ithaca, Michigan 48847, as Mortgagor, and MERCANTILE BANK OF MICHIGAN, assignee of Firstbank, f/k/a Firstbank-Alma, a Michigan banking corporation, whose address is 310 Leonard Street NW, Grand Rapids, Michigan 49504, as Mortgagee, dated August 31, 2001, and recorded in the office of the Register of Deeds for Gratiot County, Michigan on September 6, 2001, in Liber 655 at Page 772, upon which Mortgage is claimed to be due at the date of this notice the sum of THIRTY-TWO THOUSAND ONE HUNDRED SIXTY-ONE AND 55/100 ($32,161.55) DOLLARS, and no suit or proceedings at law or equity having been instituted to recover the debt secured by said Mortgage, or any part thereof; NOW, THEREFORE, by virtue of the power of sale contained in said Mortgage, and pursuant to the statute of the State of Michigan in such case made and provided, notice is hereby given that on February 26, 2015, at 10:00 a.m., said Mortgage will be foreclosed by a sale at public auction to the highest bidder, in the lobby entrance of the Courthouse in the City of Ithaca, County of Gratiot, Michigan (that being the building where the Circuit Court for the County of Gratiot is held) of the premises described in said Mortgage, or so much thereof as may be necessary to pay the amount due of said Mortgage, with interest thereon at 6.5% per annum, and all legal costs, expenses and charges, including the attorney fees allowed by law, and also any sums which may be paid by the undersigned to protect its interest in the premises, which said premises are described as follows: Land situated in the City of Ithaca, County of Gratiot and State of Michigan, to-wit: Lot 63, EXCEPT the South 13 rods and 9 feet thereof, Division M. Supervisor’s Plat to the City of Ithaca, Gratiot County, Michigan, according to the recorded Plat thereof in Liber 1, Page 48, Gratiot County Records. The redemption period shall be six (6) months from the date of such sale, unless determined abandoned in accordance with MCLA 600.3241a, in which case the redemption period shall be thirty (30) days from the date of such sale. If the property described in this Notice is sold at the foreclosure sale referred to above, the Mortgagor will be held responsible to the purchaser who buys the property at the mortgage foreclosure sale or to the mortgage holder for damaging the property during the redemption period in accordance with MCLA 600.3278 or as otherwise provided by law.
