Default having been made in the terms and conditions of a certain Mortgage made between JAMES FLIER, a single man, whose address is 5860 Keeney Drive, Six Lakes, Michigan 48886, as Mortgagor, and MERCANTILE BANK OF MICHIGAN, assignee of Firstbank-Alma Mortgage Company, a Michigan banking corporation, whose address is 310 Leonard Street NW, Grand Rapids, Michigan 49504, as Mortgagee, dated October 16, 2009, and recorded in the office of the Register of Deeds for Gratiot County, Michigan on October 21, 2009, in Liber 875 at Page 1099, upon which Mortgage is claimed to be due at the date of this notice the sum of FIFTY THOUSAND NINE HUNDRED TWO AND 05/100 ($50,902.05) DOLLARS, and no suit or proceedings at law or equity having been instituted to recover the debt secured by said Mortgage, or any part thereof; NOW, THEREFORE, by virtue of the power of sale contained in said Mortgage, and pursuant to the statute of the State of Michigan in such case made and provided, notice is hereby given that on February 11, 2016, at 10:00 a.m., said Mortgage will be foreclosed by a sale at public auction to the highest bidder, in the lobby entrance of the Courthouse in the City of Ithaca, County of Gratiot, Michigan (that being the building where the Circuit Court for the County of Gratiot is held) of the premises described in said Mortgage, or so much thereof as may be necessary to pay the amount due of said Mortgage, with interest thereon at 7.950% per annum, and all legal costs, expenses and charges, including the attorney fees allowed by law, and also any sums which may be paid by the undersigned to protect its interest in the premises, which said premises are described as follows: Land situated in the Township of Fulton, County of Gratiot and State of Michigan, to-wit: A parcel of land commencing 7 rods East of the center of Section 16, Town 9 North, Range 3 West; thence South 14 rods; thence East 2 rods; thence North 14 rods; thence West 2 rods, more or less, to the Place of Beginning, and commencing in the center of Section 16, Town 9 North, Range 3 West; thence South 14 rods; thence East 7 rods; thence North 14 rods; thence West 7 rods to the Place of Beginning. The redemption period shall be six (6) months from the date of such sale, unless determined abandoned in accordance with MCLA 600.3241a, in which case the redemption period shall be thirty (30) days from the date of such sale. If the property described in this Notice is sold at the foreclosure sale referred to above, the Mortgagor will be held responsible to the purchaser who buys the property at the mortgage foreclosure sale or to the mortgage holder for damaging the property during the redemption period in accordance with MCLA 600.3278 or as otherwise provided by law.
