Default having been made in the terms and conditions of a certain Mortgage made between TROY MEPHAM and BRANDY MEPHAM, former husband and wife, whose address is 706 Moyer Avenue, Alma, Michigan 48801, as Mortgagor, and MERCANTILE BANK OF MICHIGAN, assignee of Firstbank-Alma Mortgage Company, a Michigan banking corporation, whose address is 310 Leonard Street NW, Grand Rapids, Michigan 49504, as Mortgagee, dated April 9, 2003, and recorded in the office of the Register of Deeds for Gratiot County, Michigan on April 15, 2003, in Liber 711 at Page 704, and in the terms and conditions of a certain Home Affordable Modification Agreement executed by Troy Mepham, a single man, dated May 26, 2010, and recorded in the office of the Register of Deeds for Gratiot County, Michigan on June 7, 2010, in Liber 885, Page 509 (collectively the “Mortgage”), upon which Mortgage is claimed to be due at the date of this notice the sum of FORTY-THREE THOUSAND FIVE HUNDRED THIRTY-NINE AND 57/100 ($43,539.57) DOLLARS, and no suit or proceedings at law or equity having been instituted to recover the debt secured by said Mortgage, or any part thereof; NOW, THEREFORE, by virtue of the power of sale contained in said Mortgage, and pursuant to the statute of the State of Michigan in such case made and provided, notice is hereby given that on February 25, 2016, at 10:00 a.m., said Mortgage will be foreclosed by a sale at public auction to the highest bidder, in the lobby entrance of the Courthouse in the City of Ithaca, County of Gratiot, Michigan (that being the building where the Circuit Court for the County of Gratiot is held) of the premises described in said Mortgage, or so much thereof as may be necessary to pay the amount due of said Mortgage, with interest thereon at 3.75% per annum, and all legal costs, expenses and charges, including the attorney fees allowed by law, and also any sums which may be paid by the undersigned to protect its interest in the premises, which said premises are described as follows: Land situated in the City of Alma, County of Gratiot and State of Michigan, to-wit: Lot 190, including an 8 foot wide vacated alley adjacent to the West line thereof, Grafton Heights Addition, as recorded in Liber 1 of Plats, Page 117, Gratiot County Records. The redemption period shall be six (6) months from the date of such sale, unless determined abandoned in accordance with MCLA 600.3241a, in which case the redemption period shall be thirty (30) days from the date of such sale. If the property described in this Notice is sold at the foreclosure sale referred to above, the Mortgagor will be held responsible to the purchaser who buys the property at the mortgage foreclosure sale or to the mortgage holder for damaging the property during the redemption period in accordance with MCLA 600.3278 or as otherwise provided by law.
